Terms of Service

1. The service

Come Ricordo lets you write and keep Bios (the story of a life) and Memories (moments, trips, someone’s childhood), with text, photos and videos, and choose who can read them. The service is in a testing phase and may change, gain or lose features.

Come Ricordo is for everyone. We make no distinction of race, colour, ethnicity, origin, religion, gender, gender identity, sexual orientation, age, disability or any other condition.

2. Your account

• You must be 18 or over.
• Use your real name and an email address that is yours; the account only works once the email is confirmed.
• You look after your password and are responsible for everything done in your account. If you notice access that wasn’t you, change your password and let us know.
• Each Bio or Memory has a single author: the person who created it.

3. Your content and your responsibility

What you write and upload remains yours. So that the service can work, you authorise us to store, copy (including in backups), adapt the format of (for example, making smaller versions of photos) and show this content only as you choose in each page’s visibility. This authorisation ends when the content is erased, except for the backup period described in the Privacy Policy.

You alone are responsible for everything you put on Come Ricordo: texts, photos, videos, captions, names, dates, facts and information about other people. By publishing, you declare that:

• you have the right to use each photo, video and text you upload (copyright and image rights);
• you respect the image, honour, privacy and memory of the people you write about, living or deceased;
• when you write about a child or teenager, you are responsible for them or have the permission of whoever is, and you act in their best interest;
• what you write is not false in a way that harms anyone.

If your content causes harm to someone or violates the rights of others, the responsibility is yours. We do not review content before it is published.

4. Family photos and videos

Most family photos weren’t taken by the person uploading them, and that’s fine: you may use photos and videos from your family’s collection, or ones you were given to share. Photos by professional photographers, from newspapers or taken from the internet need the permission of whoever holds the rights.

If someone shows us that a photo is theirs and was used without permission, we may take it down.

5. What is not allowed

• illegal content, hate speech, threats, harassment or defamation;
• nudity or sexual content involving minors, in any form;
• exposing other people’s personal data without need (documents, addresses, health data) on public pages;
• content that violates copyright or image rights;
• spam, viruses, or trying to access other people’s accounts, pages or data;
• using the service for unauthorised commercial purposes.

You may not publish content that promotes hatred, discrimination or violence against people or groups because of these characteristics (section 1). Telling or documenting discrimination someone suffered, or quoting historical documents, is not forbidden: what is not allowed is promoting it.

6. Removing content and suspending accounts

We may take down content that violates these terms or the law, and suspend or close accounts that do so, with or without prior notice depending on how serious it is. We also comply with court orders.

A suspended account cannot log in, and its pages, and the comments and suggestions it wrote, are offline for readers; nothing is deleted. We tell the person why by email, and they can ask for a review or a copy of their data at info@teaminova.com.

To report a page, or to ask for something about you to be removed, write to info@teaminova.com with the link to the page and the reason, or use Report under the page’s comments. Our team may then hide the page or comment from readers; its author keeps it and is told why by email. If you disagree, reply to that email or write to info@teaminova.com, and we will review the decision.

7. Comments

On published pages, other people with an account can leave comments. The author can turn comments on or off and approve each one before it appears. Whoever comments is responsible for what they write, under the same rules as section 3.

The page’s author can reply to a comment; the reply appears with it, to whoever can see the comment.

8. When the family disagrees

Each Bio and Memory tells the story as its author remembers it. Other family members may remember it differently, and that alone is not a reason for us to take a page down.

If you disagree with something on a page, leave a comment (the author decides whether to approve it) or talk to the author. We step in, when asked, only if the content is illegal, or false and harmful to someone, for example accusing someone of a crime or exposing an illness without need. Write to info@teaminova.com with the link and the reason.

9. Public figures and living people

You may write about anyone, including public figures and historical figures, as long as it is respectful and nothing is invented.

A living person who appears on a page can ask for information about them to be corrected or removed. We will do so when the request is reasonable, after hearing the author.

10. Deleting your account

You can delete your account whenever you like, under Account → Delete my account. Everything you wrote goes offline immediately and is erased 30 days later, unless you sign in and choose "Keep my account" before then. Bios and Memories deleted one by one stay in "Recently deleted" for 30 days.

11. Plans and payments

Come Ricordo is free today, with limits on how many Bios and Memories each account can have. If we create paid plans, the conditions will be presented before any charge, and nothing will be charged without your agreement.

12. Availability and backups

We work to keep the service online and make backups every hour, but we do not guarantee that it will work without interruptions or errors, especially in this testing phase. We recommend that you also keep your own copies of important photos and texts.

13. Limitation of liability

We are liable for the harm we cause, as provided by law, including the Consumer Defence Code (Código de Defesa do Consumidor). We are not liable for content published by users, except in the cases set out in the Brazilian Internet Civil Framework (Marco Civil da Internet, Lei 12.965/2014), nor for failures caused by third parties or by use of the service contrary to these terms.

14. Changes to these terms

When we change something important, we will let you know by email before the change takes effect. If you keep using the service after that, you agree to the new terms; if you do not, you can delete your account.

15. Governing law and jurisdiction

These terms are governed by Brazilian law. If you are a consumer, the courts where you live have jurisdiction; in all other cases, the courts of Santa Cruz do Sul/RS. The Portuguese version prevails over the translations.
